These Terms & Conditions (“Terms”) govern your use of the Morphōsis Personal Training & Wellness, LLC website, membership features, coaching offers, digital resources, and related services. By accessing this website, creating an account, enrolling in a plan, or using Morphōsis services, you agree to these Terms.

1. About Morphōsis Services

Morphōsis Personal Training & Wellness, LLC provides online and virtual coaching services that may include personal training, nutrition coaching, ketogenic lifestyle strategies, mindfulness and meditation coaching, educational materials, messaging support, and related wellness resources.

Services are educational and coaching-based. They are not medical care, medical nutrition therapy, psychotherapy, emergency care, or a substitute for licensed healthcare services. Please review our Health & Fitness Disclaimer before participating.

2. Eligibility

Services are intended for adults age 18 and older. Morphōsis specializes in serving adults age 40 and older, but eligible adults outside that age range may use services unless otherwise stated.

By purchasing or using services, you represent that the information you provide is accurate and that you are legally able to enter into this agreement.

3. Accounts and Member Access

You may need to create a Wix member account or use third-party platforms, including Everfit, to access certain services.

You are responsible for maintaining accurate account information and protecting your login credentials. Do not share access to paid plans, coaching materials, app content, or member-only resources with others.

Morphōsis may suspend or terminate access when necessary to protect the business, clients, website security, intellectual property, or compliance with these Terms.

4. Monthly Memberships and Free Trials

Certain monthly recurring memberships may include a one-time, seven-day free trial.

When you begin a free trial, you must provide valid payment information. Your payment method will not be charged during the seven-day trial period. Unless you cancel before the trial ends, the selected membership will automatically begin on Day 8 and your payment method will be charged at the stated monthly rate.

Monthly memberships renew automatically each month until canceled.

The free trial is limited to one per person and may not be combined with other offers unless Morphōsis expressly states otherwise.

Trial eligibility, plan pricing, included services, billing frequency, and the date of the first charge will be presented during checkout.

5. Cancellation of Monthly Memberships

You may cancel a monthly recurring membership before the next billing date to avoid future charges. Cancellation does not create a refund for the current paid period. You will retain access to the applicable services through the end of the paid billing period, unless access is restricted for a violation of these Terms or for safety, legal, or operational reasons.

To cancel, use the available Wix account or subscription-management tools, or contact Morphōsis at Morphosisptw@gmail.com before the next billing date.

6. Prepaid Quarterly, Biannual, and Annual Plans

Quarterly, biannual, and annual plans are prepaid, one-time-payment coaching plans unless otherwise stated during checkout.

Prepaid plans do not include a free trial. Once payment is completed, prepaid plans are nonrefundable except where required by law or expressly approved by Morphōsis in writing.

Prepaid plans do not automatically renew unless a future checkout flow clearly states otherwise and you separately agree to the renewal terms.

7. Refunds and Failed Payments

Except as stated in these Terms or required by law:

• Monthly membership payments are nonrefundable after the free trial has ended.

• Prepaid quarterly, biannual, and annual payments are nonrefundable after purchase.

• Fees for completed coaching, digital resources, consultations, assessments, or other services already delivered are nonrefundable.

• Refunds will not be issued because a client does not use available services, does not complete assigned actions, changes goals, or experiences results different from personal expectations.

If a payment fails, Morphōsis may suspend access until payment is resolved. You remain responsible for any valid unpaid balance.

8. Pauses and Exceptional Circumstances

Morphōsis may allow one temporary pause for serious medical, military, or major family circumstances. Pause requests are considered case by case and are not guaranteed.

To request a pause, contact Morphosisptw@gmail.com and provide enough information for us to evaluate the request. Morphōsis may require reasonable documentation when appropriate.

Approved pauses may extend access for the unused portion of a prepaid plan or temporarily suspend a recurring plan. They do not guarantee refunds.

9. Client Responsibilities

You agree to:

• Provide accurate and current information about your goals, limitations, injuries, medications, health history, and relevant circumstances when requested.

• Follow guidance from your licensed healthcare providers.

• Seek medical clearance when appropriate before participating in exercise, dietary changes, fasting, ketogenic strategies, or other wellness activities.

• Stop activity and seek medical attention when symptoms or circumstances warrant it.

• Use respectful, lawful, and appropriate communication with Morphōsis and other community members.

• Avoid sharing, reproducing, selling, or distributing Morphōsis materials without written permission.

You are responsible for your own health decisions, participation, effort, and outcomes.

10. No Guarantee of Results

Individual results vary. Morphōsis does not guarantee weight loss, fat loss, muscle gain, body-composition changes, metabolic-health outcomes, performance improvements, stress reduction, or any other specific result.

Progress depends on many factors, including health status, effort, consistency, sleep, stress, nutrition, medications, lifestyle, medical conditions, environment, and individual response.

11. Intellectual Property

All Morphōsis content, including programs, videos, exercise instructions, coaching materials, graphics, text, logos, templates, downloadable resources, and website content, is owned by or licensed to Morphōsis and is protected by applicable intellectual-property laws.

You receive a limited, personal, non-transferable, non-commercial right to use purchased content for your own use during the applicable membership or plan period. You may not copy, distribute, modify, publish, sell, sublicense, or create derivative works from Morphōsis content without written permission.

12. Third-Party Services

Morphōsis may use third-party services, including Wix, payment processors, Google Analytics, Everfit, video-conferencing platforms, email services, and social-media platforms.

Your use of third-party services may also be governed by their own terms, policies, and privacy practices. Morphōsis is not responsible for the availability, security, content, or policies of third-party services.

13. Website Use

You may use this website only for lawful personal purposes. You may not attempt to interfere with the website, gain unauthorized access to systems or accounts, upload harmful code, impersonate another person, misuse contact features, or violate applicable law.

Morphōsis may change, suspend, or discontinue website content, services, prices, features, or availability at any time.

14. Informal Resolution and Arbitration

Before filing a legal claim related to these Terms or Morphōsis services, you agree to first contact Morphōsis at Morphosisptw@gmail.com and attempt to resolve the dispute informally and in good faith.

If a dispute cannot be resolved informally within 30 days, either party may request binding arbitration in Florida, unless applicable law requires another forum or permits the matter to proceed in small-claims court.

The arbitration will be conducted by a mutually agreed arbitration provider under that provider’s applicable rules. The arbitrator may award the same individual remedies available in court, subject to applicable law.

Nothing in this section prevents either party from seeking temporary emergency relief from a court when necessary to protect rights, safety, confidential information, or intellectual property.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or applicable consumer-protection law requires otherwise.

16. Limitation of Liability

To the fullest extent permitted by law, Morphōsis Personal Training & Wellness, LLC and its owner, representatives, contractors, and service providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website, services, recommendations, third-party platforms, or coaching materials.

To the fullest extent permitted by law, any total liability related to a claim arising from Morphōsis services will not exceed the amount you paid to Morphōsis for the applicable service during the three months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

17. Changes to These Terms

Morphōsis may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of the website or services after updated Terms become effective constitutes acceptance of the updated Terms.

For material changes affecting an active paid plan, Morphōsis may provide additional notice by email, account notice, or another reasonable method.
